Step 1: Terms of Service / User Agreement
This User Agreement ("Agreement") describes the conditions of use of the website located at
http://www.BarEssays.com (the "Website"), which is owned by BarEssays.com LLC ("BarEssays").
By clicking on the "I Agree" button below and/or registering for the Website, you agree to be
bound by all of the terms and conditions contained in this Agreement.
Registration Requirements
Where applicable, in consideration of your use of the Website, you agree to (a) provide true,
accurate, current and complete information about yourself as prompted by the website's registration
form (such information being the "Registration Data") and (b) maintain and promptly update the
Registration Data to keep it true, accurate, current and complete. If you provide any information
that is untrue, inaccurate, not current or incomplete, BarEssays has the right to suspend or terminate
your account and refuse any and all current or future use of the Website (or any portion thereof).
Member Account, Password and Security
Personal accounts may only be used by the registered user. You are responsible for maintaining
the confidentiality of the password and account. You agree to (a) immediately notify BarEssays of
any unauthorized use of your password or account or any other breach of security, and (b) ensure
that you exit from your account at the end of each session. BarEssays cannot and will not be liable
for any loss or damage arising from your failure to comply with this Section.
Cancellation
Each account cancellation request is handled on a case by case basis and, if approved, may be subject
to a $30 cancellation fee.
Privacy Policy
Except as modified by this Agreement, all terms of the Privacy Policy are incorporated by reference.

Disclaimer
BarEssays makes no warranty that (i) the Website will meet your requirements, (ii) the Website
will be uninterrupted, timely, secured, or error-free, (iii) the results that may be obtained from
the use of the Website will be accurate or reliable, (iv) the quality of any product, services,
information or other material purchased or obtained by you through the Website will meet your
expectations, and (v) any errors in the software will be corrected. Material downloaded or otherwise
obtained through the use of the Website is done at your own discretion and risk and you will be solely
responsible for any damage to your computer system or loss of data that results from the download of
any such material. No advice or information, whether oral or written, obtained by you from BarEssays
or through or from the Website shall create any warranty not expressly stated in this Agreement.
Limitation of Liability
You expressly understand and agree that BarEssays shall not be liable for any direct, indirect,
incidental, special, consequential, or exemplary damages, including but not limited to, damages for
loss of profits, goodwill, use, data or other intangible losses (even if BarEssays has been advised
of the possibility of such damages), resulting from: (i) the use or the inability to use the Website;
(ii) the cost of procurement of substitute goods and services resulting from any goods, data,
information or services purchased or obtained, or message received or transactions entered into
through or from the Website; (iii) unauthorized access to or alteration of your transmissions or
data; (iv) statements or conduct of any third party on the Website; (v) accuracy of any material
provided to you on the Website; or (vi) any other matter relating to the Website.
Your use of the website is at your sole risk. The website is provided on an "as is" and "as
available" basis. BarEssays expressly disclaims all warranties of any kind, whether expressed or
implied, including, but not limited to, the implied warranties of merchantability, fitness for a
particular purpose and noninfringement. BarEssays shall not be in default or otherwise liable for
any delay in or failure of its performance under this Agreement if such delay or failure arises by a
ny reason of any event beyond BarEssays' reasonable control, including any act of God, the elements,
earthquakes, floods, fires, epidemics, riots, failures or delay in transportation or communications.
Other Terms
If any part of this Agreement is determined to be invalid or unenforceable pursuant to applicable
law including, but not limited to, the warranty disclaimers and liability limitations set forth above,
then the invalid or unenforceable provision will be deemed superseded by a valid enforceable provision
that most closely matches the intent of the original provision, and the remainder of the agreement shall
continue in effect. A printed version of this Agreement and of any notice given in electronic form shall
be admissible in judicial or administrative proceedings based upon or relating to this Agreement to the
same extent and subject to the same conditions as other business documents and records originally
generated and maintained in printed form. All rights not expressly granted herein are reserved.
Miscellaneous
BarEssays may assign this contract, in whole or in part, at any time with or without notice to you.
You may not assign this contract, or any part of it, to any other party. The failure of BarEssays to
exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right
or provision. The section titles in this Agreement are for convenience only and have no legal or
contractual effect.
Disputes/Arbitration
If there is any controversy or dispute about, arising out of, or involving this Agreement or the
BarEssays.com website or services, you agree that the dispute shall be governed by the laws of the
State of California, USA, without regard to conflict of law provisions and you agree to exclusive
personal jurisdiction and venue in the state and federal courts of the united states located in the
State of California, City of Los Angeles. Either BarEssays or you may demand that any dispute must
be settled by arbitration utilizing the dispute resolution procedures of the American Arbitration
Association (AAA) in Los Angeles, California, USA, provided that the foregoing shall not prevent
BarEssays from seeking injunctive relief in a court of competent jurisdiction. No claim under
this Agreement may be brought by you against BarEssays more than one (1) year after the cause of
action arises.
Indemnity
You agree to indemnify and hold BarEssays, its subsidiaries, and affiliates, and their respective
officers, agents, partners and employees, harmless from any loss, liability, claim, or demand,
including reasonable attorneys' fees, made by any third party due to or arising out of your use
of the Website in violation of this Agreement and/or arising from a breach of this Agreement.
Accuracy
BarEssays does not guarantee the legal accuracy or completeness of any bar exam study material
provided on the Website including, but not limited to, outlines and/or essay examples. Use of all
material on the Website is at your own risk. You agree that you will not rely upon any of the bar
exam study material on the Website for its legal accuracy or completeness.
Copyright Notice
All content provided to you on this site, including text, graphics, logos, images and software
(including but not limited to the HTML code used to generate the pages on the website) is the
property of BarEssays and is protected by U.S. and international copyright laws. All rights are
reserved. All other copyrights, trademarks and other intellectual property rights referred to in
this website belong to their respective owners.
Agreement Modification
BarEssays reserves the right at its discretion to change the terms of this Agreement and will
notify users of any such changes by online postings and/or e-mails to subscribers of the Website.
Your continued use of the Website after the posting of any notice of change in terms shall constitute
your acceptance to be bound by any such changes. Failure to comply with any term of the Agreement
shall automatically terminate your right to use the Website.
Unauthorized Use, Distribution, Sharing or Copying
Any unauthorized use, distribution, or copying of content owned by BarEssays
or any unauthorized use, distribution, or sharing of your account will be
FULLY PROSECUTED AS THE LAW PROVIDES. At the election of BarEssays,
this may include, but may not be limited to, a termination of your account without refund,
filing of a legal action, and/or
REPORTING YOUR NAME TO THE APPROPRIATE STATE BAR OFFICIALS FOR UNETHICAL CONDUCT.
